Tuesday, Dec. 23, 1969 Turnpike Tax Tied to Study Of Toll Drop From the Newark Bureau State representatives from Newark promised yesterday to hold off introducing a bill to tax Delaware Turnpike toll receipts until the State Highway Commission decides how it might reduce tolls. Charles Eller, chairman of the commission, told Republican Reps. John G.

S. Billingsley and George Jarvis that turnpike consultants are studying the financial impact of either reducing ramp tolls outright or combining such a reduction with an increase in the stateline barrier toll. The report is due in late January or early February, Eller said. Jarvis and Billingsley have cosponsored a bill which would place a small tax on tolls collected at the barrier. The tax revenue would be used to offset a reduction of the 25-cent toll at Del.

896 and the 15-cent toll at the Del. 273 interchange. ELLER said that if the highway commission receives a favorable report from the consultants, he sees no reason why the commission and highway trustees wouldn't approve the toll reduction. The legislators pledged to hold their bill until the highway commission acts, but Billingsley said he would introduce the bill if reductions aren't effected. Before discussing toll reductions, highway officials outlined plans to double the size of the turnpike from Del.

141 to 273 and add four lanes between Del. 273 and 895. THE expansion plans were revealed by Ernest A. Davidson, state highway department director. 141 and 273, Davidson said, plans are to add two additional turnpike lanes in each direction between Del. 273 and 896, but no additional lanes between Del. 896 and the Maryland-Delaware line. All of the plans are based on a recently completed traffic and consultant study he said, and will be expensive. Financial plans currently call for the turnpike to borrow $6.5 million in July to finance the rest of the first phase, he said.

Originally, he said, the cost for the first phase was estimated at $10 million, but when the new studies were completed and recommended, concept changes had to be made in the interchange plans. Current estimates are $17 million, he said, with the Route 273 interchange alone costing $5 million. THERE would be one other large expenditure, Davidson said, a $16-million-plus bond issue would be needed in the fall of 1972 to finance the rest of the second phase and the third phase of the project. Davidson stressed that the plans still are in a preliminary stage, but Eller said: "We believe the need is there to move ahead with this planning. We can't let traffic choke us." A recent survey showed that the turnpike already is carrying the number of vehicles that earlier forecasts predicted wouldn't be using it until 1990.

IN light of the bond issues needed for the expansion, Eller noted that any tax on tolls like that proposed by Billingsley and Jarvis "would be the kiss of death to our ability to raise any money." He explained that the turnpike would be unable to sell bonds if it were taxed in any way. "I don't think so," Billingsley said, pointing out that his bill would amount to a tax on turnpike users, not the turnpike itself. HENRY Herndon, attorney for the turnpike, rebutted, saying: "No matter how you label the tax, it is a charge for use of the road. When you treat an interstate user differently than a local user, you have a problem constitutionally." Eller said that at a meeting last month of highway department and turnpike officials, the consensus was that the bill was unconstitutional because it would tax a contract and that if it were passed it probably would be tested in court. One matter that both Eller and the legislators agreed on was that, 111 Eller's words: "Elimination of the local tolls is out.

Sen. Dodd Prosecution Ruled Out Justice Department Probe Completed WASHINGTON (UPD) The Justice Department has completed its investigation into the financial affairs of Sen. Thomas J. Dodd and decided that no criminal prosecution was warranted. The decision was revealed today in a letter to Edward Bennett Williams, Dodd's attorney, from Atty.

Gen. John N. Mitchell. The letter said "this is to inform you that the United States will institute no criminal prosecution against your client. "This decision by the department is based upon the recommendations of the staff of the tax division and the assistant attorney general in charge of the tax division and the staff of the criminal division and the assistant attorney general in charge of the criminal division, that no criminal prosecution is warranted." WILLIAMS read the letter to reporters at a news conference in the Capitol after Dodd said the Justice Department decision cleared him of any wrongdoing.

Twin investigations by the Internal Revenue Service and the Justice Department were instituted after the Senate censured Dodd for converting campaign contributions to his personal use. Dodd said he had "been subjected to the most intensive investigation on every of my life" and he was "grateful" at the outcome. He said he still planned to seek re-election next year. THE Connecticut senator, with Williams at his side, met newsmen in the Senate press gallery and said it was "a lie" that the Justice Department had held the internal revenue investigation over his head during the vote on Judge Clement F. Haynsworth's nomination to the Supreme Court.

Dodd said there "wasn't a scintilla of truth" in reports that he would have voted for Haynsworth if his vote had been necessary to win him confirmation. As it turned out. Dodd's vote was not needed and he opposed the nomination. Mrs. Richard E.

Hayes Mrs. Minerva Redmile Hayes, 94, of 301 W. 22d St. died yesterday at the Delaware Division after a short illness. She was a lifelong resident of Wilmington and had lived at the above address since 1906.

Mrs. Hayes was a charter member of McCabe Memorial United Methodist Church, a member of the Mizpah Bible Class and Circle No. 7, WSCS. Her husband, Richard E. Hayes, died in 1963.

Survivors include four sons, John R. of Blue Rock Manor, Richard A. of Wilmington, James B. of Buckingham Heights and C. Russell of Newport; two daughters, Mrs.

Lulu A. Chilcutt of Wilmington and Mrs. Edith K. Johnson of New Castle Manor: six grandchildren and eight great-grandchil-tions dren. Services will be Friday afternoon at 2 at the Spicer-Mullikin Funeral Home, 24th and Market where friends may call at noon.

Cannatelli Jr. Vincent J. Cannatelli 3- day-old son of Mr. and Mrs. Vincent J.

Cannatelli of 2611 Exeter Road, Afton, died Sunday at General Division, where he was born Dec. 18. The father said the cause of the baby's death was respiratory. Surviving in addition to the Cannatellis are the baby's paternal grandparents, Mr. and Mrs.

of Silverside Road. Services and interment were private. Zerfoss Rites Friday Services for Daniel E. Zerfoss, University of Delaware history instructor, will be Friday afternoon at 2 from Hunters Funeral Home in Saltsburg, Pa. Mr.

Zerfoss, 28, of Towne Court Apartments, 161 Thorne Lane, Newark, died early Sunday morning from injuries sustained Saturday in a highway accident near Avondale, Pa. It is believed that Mr. Zerfoss, who was not married, was on his way to spend the Christmas holidays with his parents, Mr. and Mrs. Ernest Zerfoss, in Clarksburg, when the accident occurred.

He died in Delaware Division. where he was transferred from the Community Memorial Hospital, West Grove, Pa. He joined the faculty of the University of Delaware in 1968 and had recently completed his doctoral studies at Harvard University. Mrs. John J.

Worth Mrs. Alice E. Worth, 83, of 3002 Jefferson died yesterday morning at Memorial Division after a long illness. She was the widow of John J. Worth, who died two years ago.

Mrs. Worth was a native of Wilmington and had lived here all her life. She was a member of Eastlake United Methodist Church. She left no immediate survivors. Services will be tomorrow morning at 10 at McCrery Funeral Home, 2700 Washington St.

Interment will be in Riverview Cemetery. There will be no viewing. James H. Bedford James H. Bedford, 91, of 200 W. Summit Elmhurst, died at Newark Manor Nursing Home, 254 W. Main Newark, after a long illness.

He retired in 1947 after 52 years with the Danforth Drug Stores. He was a native of the Wilmington area, and had lived in Elmhurst for the past 37 years. Mr. Bedford belonged to St. James Episcopal Church of Newport, and was junior warden emeritus of the vestry there.

He is survived by his widow, Mrs. Jane M. Bedford. Services will be tomorrow afternoon at 2 at St. James Church, Augustine St.
