Cunning, who waa ono of the heirs-at-law of Mrs. Rala-ton, for $2,00, subject to an allowance of the amount due on a certain mortgage, executed by a prior owner. Mrr. 'aiming, through her counsel, Edwin Cochran, declined to take title, on the ground that the property ought to have been aold bv an administrator for the payment of dehts, instead of in partition proceedings. The time for acting upon the return was -onnriucd from tim to timn until January of this year, when the court extended the tune for filing exceptions until January 4th and set January 10th an the date for hearing argument on exceptions No exceptions were tiled and today the court approved the sale and it appearing that the purchaser had neglected and refused to comply with terms and condition of sale or onter a recognizance for purchase price as required by law, it was further ordered that said return be set aside, and a renewed order of sale was made returnable February 21st.
